SESSIONS FIRES BACK AT CHICAGO: “COMPLY WITH THE LAW OR FORGO TAXPAYER DOLLARS”
AG SESSIONS: “This administration will not simply give away grant dollars to city governments that proudly violate the rule of law and protect criminal aliens at the expense of public safety. It is this simple: Comply with the law or forgo taxpayer dollars.”
AG Sessions announced last month that local governments would stand to lose certain federal grants if they prevent immigration agents’ access to local jails or they do not give advance notice when illegal immigrants are set to be released from custody. Jurisdictions that refuse to cooperate would loose funding under Justice Assistance Grants and the State Criminal Alien Assistance Program, which provide hundreds of millions of dollars a year to local law enforcement.
Chicago Mayor Rahm Emanuel said the city won’t be “blackmailed” into changing its policies. AG Sessions shot back, saying Chicago is suffering from a “culture of lawlessness.”
AG Sessions: “To a degree perhaps unsurpassed by any other jurisdiction, the political leadership of Chicago has chosen deliberately and intentionally to adopt a policy that obstructs this country’s lawful immigration system. They have demonstrated an open hostility to enforcing laws designed to protect law enforcement – federal, state, and local – and reduce crime, and instead hav adopted an official policy of protecting criminal aliens who prey on their own residents.” Washington Times
Rham Emanuel calls on the Fourth Amendment to the Constitution. Correct me if I am wrong, but the U.S. Constitution applies to U.S. Citizens only, right? Not to Criminal Illegal Aliens that their first deed in the U.S. is to break its laws.
The fourth amendment states:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
The idea behind probable cause is to prevent the sort of police states that exist in other countries, where officials can simply round up people they don’t like as “undesirables” or “threats” without any justification. This standard is deliberately vague, but over time the interpretation of what constitutes probable cause has become fairly solidified:
Probable cause is established through factual evidence, and not just suspicions or hunches.
Probable cause can be established through observation alone (sight, smell, sound, etc.), and includes observations that create suspicion based on a familiar pattern of criminal activity, such as when an officer sees a car circling around an area repeatedly or when someone is flashing their headlights. Probable cause can be based on information derived from witnesses, victims and informants.
Probable cause can be based on police expertise, such as recognition of gang signs, detection of tools appropriate for committing certain crimes, or knowledge of movements and gestures that indicate criminal activity. Probable cause can be based on circumstantial evidence that only indirectly indicates that a crime has occurred, such as a broken window.
Who Decides Whether an Officer had Probable Cause?
While probable cause needs to be established before an arrest by the police officer, probable cause can be determined after the fact by a judge. This means that an officer could have in good faith thought he or she had probable cause, but a judge can later determine that there was in fact no probable cause. If this occurs, evidence acquired without probable cause becomes inadmissible in court.
Also, even if it turns out that the police were wrong and a suspect is later acquitted, it doesn’t affect the determination of probable cause. Probable cause is extremely important to the police, because even if the suspect is found to be innocent, the finding of probable cause shields the police from lawsuits.
Rahm Emanuel accuses President of blackmail in battle over funding for sanctuary cities. But what the President is trying to do is enforce U.S. Law on the books to protect U.S. Citizens and maintain order.
President Trump is also working to protect our Police Officers that are the ones out there enforcing the laws on the books. They are placed in extreme danger, because they have to face criminal illegals aliens in their cities and towns that bring drugs and crime to their cities. Rham Emanuel is more worried about protecting illegal aliens and not Chicago’s citizens. Fox News mentioned that Chicago has a large Latino community and that they are politically active.
One very important point that Rham Emanuel does not realize is that Legal Immigrants, specifically Latinos, are the strongest supporters of following U.S. Laws because they want their communities to be safe and they don’t want illegals taking their jobs.
Fox News had on SHERIFF THOMAS HODGSON, of Bristol County, Massachusetts, and he supports President Trump. Sheriff Hodgson stated that it is political what Emanuel is doing, we are a country and we must follow laws. If you are a police officer on the streets, it is very difficult to keep it safe since Emanuel does not cooperate with the federal government. All the people in that community face serious injury to crimes committed by illegal aliens.
The FAA, the FTC, FCC are all agencies regulated by laws. Rahm Emmanuel took an oath to uphold the law. He is choosing which parts of the laws to enforce and follow. It is a conflict between local, state and federal laws.
We have a flawed immigration system. There are talented people who want to follow the law and be good immigrants. Legal Immigrants do not support lllegal immigration since it takes away jobs from their communities.
In legal immigration law, we must target the people with the right set of skills to come here, get a job and contribute to our society and not to drain our services paid by and originally created for our American citizens. Rham Emmanuel also said the president has no right to enforce immigration laws. That is criminal.
Half the businesses are owned by immigrants in Chicago. Emmanuel does not understand that POTUS Trump is talking about illegal immigrants that are causing all these problems. Mostly, Rahm Emanuel’s violation of the law is becoming a threat to Chicago and its citizens.
We will see where this situation ends up in the courts with Rham Emanuel deliberately violating U.S. Immigration law And Attorney General Jeff Sessions, who enforces the laws on the books and is fighting to keep up safe together with President Trump. Stay tuned.
